Terms of Service

These Terms of Service ("Terms") govern your use of Charm ("the Software"), developed by Theodore Harding trading as THEODORE ("we", "us", "our"). By purchasing or using Charm, you agree to these Terms.

1. License

We grant you a non-exclusive, non-transferable license to install and use Charm on up to three (3) devices per license key for personal or commercial use. This license is perpetual for the version purchased.

You may not:

  • Redistribute, sublicense, or resell the Software.
  • Reverse engineer, decompile, or disassemble the Software.
  • Remove or alter any proprietary notices or labels.
  • Use the Software for any unlawful purpose.

2. Purchase and Payment

Charm is available as a one-time purchase for $9.99 (USD). Payment is processed by Polar. By completing a purchase, you agree to Polar's terms of service.

3. Digital Content and Right to Cancel

Charm is digital content as defined by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. By purchasing and downloading Charm, you:

  • Consent to the immediate delivery of digital content.
  • Acknowledge that you lose your right to cancel once the digital content has been delivered.

4. Refunds

All sales are final. Due to the nature of digital products, we do not offer refunds or returns. By purchasing Charm, you acknowledge and agree to this no-returns policy.

5. Consumer Rights

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015. The Software is provided as digital content which must be:

  • Of satisfactory quality.
  • Fit for a particular purpose.
  • As described.

If the Software does not meet these standards, you are entitled to a repair, replacement, or refund as provided by law.

6. Updates

Your license includes free updates to the current major version of Charm. We may release updates at our discretion. We are not obligated to provide updates indefinitely.

7. Accessibility Permissions

Charm requires macOS Accessibility and Input Monitoring permissions to function. These permissions allow Charm to read and correct text in real time. Charm uses these permissions solely for the purpose of providing its correction features and does not collect, transmit, or store any data accessed through these permissions.

8. Limitation of Liability

To the maximum extent permitted by law, our total liability arising from or related to your use of the Software shall not exceed the amount you paid for the Software.

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any liability that cannot be excluded by law, including your statutory rights under the Consumer Rights Act 2015.

9. Disclaimer

The Software is provided "as is" to the extent permitted by law. We do not guarantee that the Software will be error-free or uninterrupted. Corrections are provided as suggestions and may not always be accurate.

10. Termination

We may terminate your license if you breach these Terms. Upon termination, you must uninstall and cease using the Software.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

13. Changes

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the Software after changes are posted constitutes acceptance of the updated Terms.
