These terms govern your use of Solace, a macOS application supplied by:

References to "THEODOREHQ", "we", "us", or "our" mean TJH/CO LIMITED. By downloading, installing, or using Solace, you agree to these terms.
Licence
THEODOREHQ grants you a personal, non-exclusive, non-transferable, revocable licence to install and use Solace on any Mac computers that you own or control, for personal or professional use, subject to the activation limit set out at checkout (currently three devices per licence key).
Purchase
Solace is available as a one-time purchase. There are no subscriptions or recurring fees.
Intellectual property
Solace and all associated materials — including the application code, design, website, and documentation — are the intellectual property of TJH/CO LIMITED. All rights not expressly granted in these terms are reserved.
Restrictions
You may not:
- Reverse-engineer, decompile, or disassemble the application
- Modify, adapt, or create derivative works based on the application
- Redistribute, sublicence, rent, lease, or lend the application
- Remove or alter any proprietary notices or labels
Disclaimer of warranties
Nothing in these terms affects your statutory rights as a consumer. In the United Kingdom, digital content must be of satisfactory quality, fit for purpose, and as described under the Consumer Rights Act 2015 (sections 34–36), and these rights cannot be excluded or limited.
Subject to your statutory rights, Solace is provided "as is" and "as available". To the fullest extent permitted by applicable law, THEODOREHQ makes no additional warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the application will be error-free, uninterrupted, or free of harmful components.
Accuracy of calculations
Sunrise, sunset, and solar position calculations are estimates based on standard astronomical algorithms. Weather data is provided by Apple WeatherKit and may not always reflect real-time conditions. These features are provided for convenience and should not be relied upon for safety-critical or time-sensitive decisions.
Limitation of liability
To the maximum extent permitted by applicable law, the total liability of TJH/CO LIMITED arising out of or in connection with your use of Solace shall not exceed the amount you paid for the application.
In no event shall TJH/CO LIMITED be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by applicable law, including your statutory rights under the Consumer Rights Act 2015 (s.31).
Tax and VAT
The price you pay at checkout is the price as displayed by Polar, our payment processor and merchant of record. Polar handles VAT, sales tax, and equivalent indirect taxes for jurisdictions where they apply, calculating and remitting them on our behalf. The receipt issued by Polar is your tax invoice. Customers in jurisdictions where reverse-charge or self-assessment of VAT applies should consult their own tax adviser.
Right to cancel and refunds
Solace is digital content within the meaning of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 ("CCRs").
If you purchased Solace through the Mac App Store, refunds are handled by Apple under their refund policy. THEODOREHQ has no role in those refunds.
If you purchased Solace directly through Polar, the standard 14-day cooling-off right under CCRs Regulation 29 applies, with the following important detail. CCRs Regulation 37(1) allows immediate delivery of digital content only where you (a) expressly consent to immediate provision and (b) expressly acknowledge that you lose your right to cancel by doing so. By proceeding through checkout and accepting immediate delivery of your licence key, you provide that consent and acknowledgement.
Notwithstanding any waiver of the cooling-off right, your statutory rights under the Consumer Rights Act 2015 (satisfactory quality, fit for purpose, as described — sections 34 to 36) remain in full force. If Solace does not meet those statutory standards, you are entitled to repair, replacement, price reduction, or refund under the CRA. Email support@theodorehq.com with details and we will respond within five working days.
Marketing communications
After you purchase Solace, we may send occasional product update emails to the email address used at checkout — feature announcements, usage tips, and news about Solace and related macOS products we develop. Our lawful basis is legitimate interests under UK GDPR Article 6(1)(f).
You may opt out at any time by ticking "I'd prefer not to receive product updates" on the download confirmation page after purchase, by clicking the unsubscribe link in any marketing email, or by emailing support@theodorehq.com. Opting out will not affect transactional emails related to your purchase or licence key. Full details are set out in our Privacy Policy.
Termination
You may stop using Solace at any time by uninstalling it. We may revoke your licence and terminate this agreement if you (a) materially breach these terms, (b) initiate a payment chargeback or dispute without first contacting support@theodorehq.com, or (c) we have reasonable grounds to believe the licence was obtained fraudulently. Upon termination, you must delete all copies of the application. Termination does not affect any statutory rights you have as a consumer or any refund you are owed under the Consumer Rights Act 2015.
Updates
We may release updates to Solace from time to time. These terms apply to all updates unless accompanied by separate terms. Updates are provided at our discretion and are not guaranteed.
Governing law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, nothing in these terms affects your statutory rights or your right to bring proceedings in the courts of your country of residence. Mandatory consumer protection laws of your country of habitual residence will continue to apply regardless of the governing law chosen.
Severability
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Changes to these terms
We may update these terms from time to time. The revised version will be posted on this page with a new "Last updated" date at the top. For material changes that reduce your rights, we will give existing customers at least 14 days' notice by email before the changes take effect. Material changes will not apply retroactively to purchases made before the change. If you do not agree with the updated terms, you should stop using Solace.
